| Proposed Amendments to the Trademark Act |

KIPO proposed amendments to the Trademark Act recently. The amendments propose strengthening protection of well-known marks in Korea. According to the amendments, registration of an imitation mark under the first-to-file principle will be more difficult because the level of fame will be lwered to bar registration of an imitation mark.
Also, KIPO will expand the scope of trademark types that may be registered. Accordingly, it will be available to protect nontraditional marks such as motion marks, hologram marks and color per se marks.
