| Bill to Amend Secret Design System |

KIPO prepared a Bill for amend the current secret design system, which is expected to be effective from July 1, 2007. Within 3 years from the registration date of design, the applicant can request KIPO to keep the design confidential and not be disclosed. At present, an applicant can request secrecy protection of a design application at the filing date of for design application.
According to KIPO, the period for applying a secret design will be extended. Under the new regulation, an applicant can request the secrecy protect order during the period from the filing date to the date of actual payment of the registration fee for design registration.
KIPO strive to expedite examination and the examination period has been short from 8.4 months in 2004 to 5.9 months in 2006. An applicant may need more time to commercialize the design and wish to keep the design in secrecy before its sale. New law will provide owners of design with flexibility.
